Analysis of the practical application...


Seven years have passed since the Antidiscrimination Law had been adopted in Slovakia in 2004. In order to ensure full implementation of the equal treatment principle, it is necessary to take stock and analyse the main challenges and barriers barring victims of discrimination from using the full extent of the Antidiscrimination Law. Available research confirms that only a small percentage of all discrimination cases are filed by victims of discrimination with the courts. However, there is no analysis as to the causes influencing the low level of use of the Antidiscrimination Law. This activity is therefore closely connected to the objective of improving the implementation of the non-discrimination legislation.

The purpose of the analysis is to identify the main factors influencing the inadequate application of anti-discrimination legislation in Slovakia in terms of institutional support in the courts and in the Equality Body, with the aim to create the basis for legislative changes and formulation of short-term and medium-term state policies in this area. The analysis, as well as other project outputs, will be published on the website diskriminacia.sk.

Experience in overcoming the insufficient application of the EU legislation in the area of anti-discrimination can also be further disseminated to other new members of the EU in eastern and south-eastern Europe. This dissemination will be achieved by ensuring participation of the experts from this region at the symposium.
